Payment Terms
For work priced under $100 USD, all payment excluding shipping will be paid before work begins. For work over $100, clients have the option of a non-refundable 30% of the payment to be paid before work begins. The other part of the payment will be paid by invoice after the initial check in point is approved by the client.
Feedback & Points of Change
The client will be contacted for progress pictures and feedback at the following points per medium:
Small Illustrations Digital: Sketch, Final*
Full Illustrations Digital: Sketch, Linework, Flat Colors, Final*
Physical painting: Sketch & Rough Color Palette
Original sculpture: Rough Forms, Details
Original Cast sculpture: Rough Forms, Details
Cast sculpture: None
Other: Defined in the invoice as needed
Additional screenshots or photos will not be available as this slows down the work progress. It is the client’s responsibility to bring up any items of change at the point of feedback as once approved, past stages will not be revisited.
*On digital work ONLY minor changes may be done at the point of final approval. Major changes will result in an additional fee based on the scope of the changes desired.
communication
Communication will be handed through e-mail or Discord by the clients choice. Communication outside of those two forms will be directed back there. Items or conversation outside of the topic of the work may be ignored or moved aside. The artist reserves the right to contact the client for clarifying information as needed.
Copyright
Unless specifically waived in the invoice, the artist retains the copyright to the work and all commercial rights there in. The client has no right to reproduce the work* for profit or non-profit uses. If a client wishes to purchase commercial rights, the client is responsible to discuss such matters BEFORE first payment is made.
*Clients may print single instance digital work for their personal collection.
NFTs: Clients are NOT allowed to use commissioned work for NTFS or any other cryptocurrency or block chain based uses.
Reserved Rights: The artist reserves the right to use the piece within the terms of their business. This may mean merchandise, art books, prints, portfolios, marketing material, websites, social media, and other such uses.
Character Rights:
Client Character: All rights to the character and stories are retained by the client.
Adoptable: All rights to the character and stories are transferred to the client.
Artist Characters: All rights to the characters and stories remain with the artist.
Commercial Characters: All rights belong to the parent corporation.
Clients are responsible to discuss any additional matters or concerns BEFORE first payment is made.
DELIVERY
Digital: Digital work will be delivered by email or Google Drive in the forms agreed on per work. If no forms are discussed, the form of the final work will be a high quality .jpg. Here high quality means a dpi 300 or over (as scaled to size) and of an appropriate print or display size for the work.
Physical: Delivery and all fees there in are responsibility of the client are NOT part of the base price of work. Work will be shipped USPS as the primary choice, but UPS will be an option if requested. Clients will be notified prior to shipping to confirm the address. After the address is confirmed it cannot be changed. When available, the client will be given a tracking number. For shipping locations considered high risk* tracking and insurance is required and the onus of risk is the responsibility of the client.
